                          RESOLUTION #84-F-08

     WHEREAS, the Affiliated Tribes of Northwest Indians during 
              the Annual Conference did review and discuss the 
              passage of the Land Consolidation Act of 1982; and  
     
     WHEREAS, the general consensus of the Affiliated Tribes of 
              Northwest Indians that the intent of Congress was 
              to address a long standing problem of fractionated 
              landownership; and  
     
     THEREFORE BE IT RESOLVED, that the Affiliated Tribes of 
              Northwest Indians does hereby recommend the 
              following:  
     
              1. The ESCHEAT PROVISION of the Act be amended so 
                 that in the instance when there are no HEIRS 
                 that are ENROLLED members of that reservation, 
                 the property would then escheat (legal term 
                 definition: a person dying without a will or 
                 legal heirs) to the Tribe.  
     
              2. The Congress appropriated funds for the land 
                 acquisition section under the Indian 
                 Reorganization Act be amended to reflect this 
                 principle.  
     
     BE IT FURTHER RESOLVED, that the Affiliated Tribes of 
              Northwest Indians submit the above recommendation 
              to the 41st Annual Convention of the National 
              Congress of American Indians for their 
              consideration and support.  
     
     
                             CERTIFICATION

     The foregoing resolution was duly endorsed at the Annual 
     Conference of the Affiliated Tribes of Northwest Indians, at 
     Spokane, Washington, on September 8, 1984, with a quorum 
     present and voting.
