                   N O R T H W E S T   I N D I A N S

                         RESOLUTION #84-F-010

     WHEREAS, the Affiliated Tribes of Northwest Indians (ATNI) 
              is a regional organization comprised of American 
              Indians from the States of Oregon, Idaho, 
              Washington, and Nevada; and  

     WHEREAS, the Affiliated Tribes of Northwest Indians 
              recognizes the needs and concerns of the member 
              Tribes and the serious impact upon Native American 
              Indians when specific issues are collectively 
              addressed by Local, Regional, and National Indian 
              governments and their organizations; and  

     WHEREAS, the Affiliated Tribes of Northwest Indians is 
              dedicated to the ideals of improvement of health, 
              education, social welfare, and economic development 
              of American Indians; and  

     THEREFORE BE IT RESOLVED, that the Affiliated Tribes of 
              Northwest Indians and its membership does hereby 
              support the attached resolution as submitted by the 
              Kootenay Indian Area Council (Cranbrook, British 
              Columbia, Canada) in representation of the St. 
              Mary's Band, Columbia Lake Band, Shuswap Band, 
              Lower Kootenay Band and the Tobacco Plains Band of 
              Canada to request support regarding the 
              infringement of the aboriginal border crossing 
              rights of the Kootenay Indian people and in support 
              of their nation's aboriginal trading, and inter-
              indigenous cultural relationships and submits this 
              resolution to the National Congress of American 
              Indians (NCAI) Annual Convention in Spokane, 
              Washington on September 9-14, 1984 requesting their 
              support, action, resolution and submission to the 
              proper authorities or agencies; and  

     BE IT FURTHER RESOLVED, that the National Congress of 
              American Indians take the necessary action to 
              satisfactorily resolve the resolution as endorsed 
              and adopted by the Affiliated Tribes of Northwest 
              Indians.  


                             CERTIFICATION

     The foregoing resolution was duly endorsed at the Annual 
     Conference of the Affiliated Tribes of Northwest Indians, at 
     Spokane, Washington, on September 8, 1984, with a quorum 
     present and voting.

                              ATTACHMENT


                     KOOTENAY INDIAN AREA COUNCIL
                     SITE 15, MISSION RD. S.S. #1,
                        CRANBROOK, B.C. V1C 4H4

                              RESOLUTION
     
     WHEREAS: the member Bands of the Kootenay Indian Area 
              Council; St. Mary's Band, Columbia Lake Band, 
              Shuswap Band, Lower Kootenay Band and Tobacco 
              Plains Band, have adopted a KOOTENAY NATION LAND 
              CLAIM AND DECLARATION, July 8, 1981, and;  
     
     WHEREAS: the Declaration stated that the Kootenay people 
              have tolerated "the disruption of our inalienable 
              right to sovereignty", and;  
     
     WHEREAS: one of the disruptions was the establishment of the 
              Canada/USA border, separating the Kootenay Nation 
              in the eyes of the Canadian and American 
              Governments, despite the traditional laws of the 
              Kootenay Nation, and;  
     
     WHEREAS: the Kootenay Nation has never ceded their 
              traditional laws or recognized that our people are 
              separated by an international boundary. The 
              Kootenay Nation continue to respect and protect the 
              right of a Kootenay Indian to travel, live and work 
              within the traditional territory of the Kootenay, 
              and; 
     
     WHEREAS: the Kootenay people both north and south of the 
              international boundary therefore have never 
              accepted the Canadian/American boundary as 
              applicable to the Kootenay Nation. Nor does the 
              Kootenay Nation accept the authority of the 
              Immigration Act as applicable to the Kootenay 
              Nation because the Kootenay have never been 
              immigrants in our own land, and;  
     
     WHEREAS: the member Bands of the Kootenay Indian Area 
              Council reserve the sole right to employ people of 
              Kootenay ancestry within our administration, and;  
     
     WHEREAS: Margaret Friedlander, a Kootenay Indian from the 
              Confederated Salish and Kootenay Tribe of Montana 
              has been hired by the Tobacco Plains Band as Band 
              Administrator based on her qualifications, in 
              addition to her understanding of the Kootenay 
              culture and language, and;  
     
     WHEREAS: attempts have been made by the Canadian Government 
              to remove Margaret Friedlander from Canada.  
     
     THEREFORE BE IT RESOLVED that the National Congress of 
              American Indians supports the stand taken by the 
              Kootenay Nation regarding aboriginal border 
              crossing rights, based on our knowledge that the 
              international boundary is an arbitrary line drawn 
              without consideration of indigenous peoples, and 
              violating their nations aboriginal trading 
              relationships and inter-indigenous cultural 
              relationships.
